These Terms of Service govern your access to and use of the docare website and practice-management platform. By creating an account or using the service, you agree to these terms.
1. The service
docare provides software for managing a medical practice, including patient records, appointments, consultations, prescriptions, documents, laboratory results, public professional profiles and doctor-initiated AI assistance. docare is a software tool. It does not practise medicine, provide medical advice or make clinical decisions.
2. Accounts and eligibility
You must be legally able to enter into these terms and must provide accurate account information. The service is intended for licensed healthcare professionals and their authorised staff. You are responsible for keeping login credentials confidential and for all activity under your account. Tell us promptly if you believe your account has been compromised.
3. Subscriptions and payment
Paid plans are billed monthly at the price displayed before checkout. Payment is processed by our payment provider, Creem. You authorise the applicable recurring charge when you subscribe. You may cancel at any time; cancellation normally takes effect at the end of the current paid billing period, and access to paid features may continue until then. Unless required by law or stated at checkout, fees already paid are non-refundable.
4. Your responsibilities
You are responsible for your professional licences and authorisations; the lawful basis for entering and using patient information; the accuracy of information you add; obtaining any notices or permissions required from patients; configuring communications appropriately; and reviewing every AI-generated draft before it becomes part of a record or is sent to a patient.
5. AI assistance
AI features can be wrong, incomplete or unsuitable for a particular situation. They are provided as assistance, not as a substitute for professional judgement. You remain responsible for clinical decisions, patient records, prescriptions, communications and any action taken based on information shown by docare.
6. Acceptable use
You may not use docare to access another person's data without authorisation, send unlawful or unsolicited marketing, upload malicious code, interfere with the service, attempt to bypass security, infringe another person's rights, or violate applicable law or professional rules.
7. Your content and our rights
You retain rights in the content you submit. You grant docare the limited rights needed to host, process, transmit, back up and display that content to provide the service. You confirm that you have the rights and permissions needed to submit it. docare and its software, branding and documentation remain its property or the property of its licensors.
8. Availability and liability
We work to keep docare available and reliable, but the service may be interrupted for maintenance, updates, provider outages or events outside our reasonable control. To the extent permitted by law, docare is provided without warranties beyond those that cannot legally be excluded. docare is not liable for indirect or consequential loss, loss of data caused by your failure to maintain appropriate records or backups, or clinical decisions made using the service.
9. Suspension and termination
We may suspend or terminate access if you materially breach these terms, create a security or legal risk, fail to pay, or use the service unlawfully. You may stop using the service and cancel your subscription at any time. Where practical, we will provide notice and a reasonable opportunity to address a breach. After termination, we may retain information when required by law or the Privacy Policy.
10. Changes and contact
We may update these terms to reflect changes to the service or applicable requirements. The date at the top shows when they were last updated. We will provide additional notice for material changes where required. Questions about these terms can be sent to the customer support address shown below.
